Terms and Conditions – Novaro Melbourne

Article 1 – Definitions
In these terms and conditions:

Cooling-off period: The period within which the consumer may exercise their right of withdrawal.

Consumer: A natural person not acting in the course of a business or profession who enters into a distance contract with the trader.

Day: Calendar day.

Ongoing contract: A distance contract relating to a series of products and/or services where the delivery or performance is spread over time.

Durable medium: Any tool that enables the consumer or trader to store information for future reference and unaltered reproduction.

Right of withdrawal: The consumer's right to cancel the agreement within the cooling-off period.

Trader: The natural or legal person offering products and/or services remotely.

Distance contract: An agreement concluded via a system for remote sales or services organised by the trader.

Means of distance communication: Tools for concluding a contract without the consumer and trader being physically present.

Terms and conditions: These terms and conditions of the trader.

Article 3 – Applicability
These terms and conditions apply to every offer and distance agreement between the trader and consumer.
Prior to the conclusion of a distance contract, the consumer will be provided with a copy of these terms. If this is not feasible, the consumer will be informed where they can access or request them.
For electronic contracts, the terms will be provided in a format that allows easy storage and access.
In case of conflicting terms, the provisions most favorable to the consumer shall apply.
If any clause is void or annulled, the remaining provisions remain in force.
Australian Consumer Law Compliance:
For customers residing in Australia, Novaro Melbourne complies with the Australian Consumer Law (ACL). This includes consumer guarantees relating to product quality, description accuracy, and refund rights for faulty or misrepresented goods.
Article 4 – The Offer
Offers are non-binding and may be modified by the trader.
Descriptions and images must be accurate and truthful.
Obvious errors do not bind the trader.
Consumer rights and obligations (e.g., pricing, delivery, payment, withdrawal) are clearly outlined.
Article 5 – The Agreement
The agreement is concluded when the consumer accepts the offer and meets the specified conditions.
Upon electronic acceptance, the trader will confirm receipt without delay.
The trader will implement appropriate technical and organizational measures to secure electronic data transmission.
Article 6 – Right of Withdrawal
Consumers have 14 days to withdraw from the agreement without providing reasons.
During this period, consumers must handle products and packaging with care.
Article 7 – Costs in Case of Withdrawal
Change of Mind Returns:
Return shipping costs are borne by the consumer if the return is due to change of mind.
If a product is faulty, unsafe, or not as described, Novaro Melbourne will cover the reasonable cost of a replacement or provide a refund in accordance with the ACL.
Article 8 – Exclusion of Right of Withdrawal
Withdrawal may be excluded for:

Custom or personalized items

Perishable goods
-
Sealed hygiene-sensitive products, if unsealed
Such exclusions must be clearly stated before the agreement is concluded.
Article 9 – Pricing
All prices listed include VAT (GST where applicable).
Prices will not change during the offer period, unless due to changes in tax legislation.
Article 10 – Compliance and Warranty
Products must comply with the agreement and meet reasonable expectations of quality and performance.
Complaints must be reported within 14 days of delivery.
Consumer guarantees apply regardless of any additional warranties.
Article 11 – Delivery and Performance
Orders must be delivered within 30 days, unless otherwise agreed.
If delivery is delayed, the consumer may cancel the agreement and request a refund within 14 days.
Article 12 – Ongoing Contracts
Fixed-term agreements may be terminated with a maximum one-month notice at the end of the period.
Automatic renewal is not permitted, except for contracts of up to three months.
Article 13 – Payment
Payment must be made within 7 days, unless otherwise agreed.
Inaccuracies in payment data must be reported immediately.
Article 14 – Complaints
Complaints must be submitted within 7 days of delivery.
The trader will respond within 14 days with a resolution.
Article 15 – Disputes
These terms and conditions are governed exclusively by Dutch law, even if the consumer resides abroad.
This does not affect the rights granted under mandatory local consumer protection laws (e.g., Australian Consumer Law) if applicable.
